Delhi High Court Questions Fairness of CCI Proceedings in Case Involving Major Logistics Companies; Federation of Indian Publishers’ Writ Petition Heard

The Hon’ble Delhi High Court, while hearing a writ petition filed by the Federation of Indian Publishers (FIP), today raised serious concerns regarding the fairness and procedural conduct of proceedings before the Competition Commission of India (CCI) in an ongoing investigation involving major logistics and courier companies.

During the hearing, the Division Bench, presided over by the Hon’ble Chief Justice, questioned whether the proceedings before the CCI and its investigative arm, the Director General (DG), were being conducted in a fair and balanced manner. The Court’s observations came in the context of FIP’s challenge to multiple ex-parte orders, denial of access to case records, restrictions on cross-examination, and the constitutional validity of certain provisions of the CCI (General) Regulations, 2024.

The writ petition also raises significant issues concerning violation of principles of natural justice, procedural impropriety, and the impact of such actions on effective legal representation and due process.

The Federation of Indian Publishers was represented before the Hon’ble Court by Senior Advocate Shri J Sai Deepak, along with Advocate Shri Rahul Goel and Ms. Anu Monga, Partners at AnantLaw.

Pranav Gupta, Vice President, Federation of Indian Publishers, said:
“The observations made by the Hon’ble Delhi High Court today reaffirm the Federation’s long-standing concern that fairness, transparency, and due process cannot be compromised in regulatory proceedings. Competition law enforcement must be anchored in the rule of law and natural justice. We are grateful that the Hon’ble Court has taken cognisance of these serious issues, which go beyond one case and impact the credibility of the regulatory framework itself.”

The matter is expected to be taken up for further hearing in due course. The Federation remains committed to pursuing the matter through appropriate legal channels.
